Eric Acomb told a meeting of the town council that it would only take a fall head-first on to one of the protruding flagstones on Hillcrest Avenue for it to result in death. This has been an ongoing issue for many years,it is disgraceful, and it seems that everyone dodges it/passes the buck/pretends it will go away, when we all know it will not and someone will get hurt again one of these days. Why does the Town Council not find out how much it will cost, and raise the money from local funds? This will show that local people can solve local problems, and it will shame those who keep passing the buck to someone else? |

I fear it will take a fall and injury to someone, followed by a sucessful claim for personal injury before the council do anything, even then they might not as it will probably end up being the householders adjacent to the pavement who are liable. 9 out of 10 times now I cross over and walk on the co-op side, the pavement is just too uneven on 'tother side. |

Somebody must know exactly who is responsible for the pavements, it surely cannot be that difficult to identify who it is? |

It's an unadopted road although it leads to other roads which have been adopted. Please read my first post in this thread and follow the reference links to see how unfair this really is for the residents of Hillcreast Avenue. ![]() |

This is a paradise for lawyers, having read all the previous links etc. It needs a case to be brought for personal injury, sadly, for this to be resolved, and it will cost a fortune, going to QC level for sure. Everyone avoids liability, there is clear negligence on someone's part if a member of the public is badly injured, you can tell just by looking at the pavement condition in particular. It seems clear that the original intention was for the Co-op to make things secure, but it appears it was never followed through by Bradford MDC.The Co-op is a community organisation owned by its members, and maybe those members, and the rest of us, should stop using the shop until they at least attempt to address the problem.They are a huge commercial organisation, and it's on their doorstep. I bet Tesco, Morrison's or Sainsburys would sort it. Nothing is ever going to happen, everyone blames everyone else! Only the law can decide if a case presents itself, and it will, one of these days. |

this post has been edited 1 time(s) Who put the double yellow lines and other markings on the road? To my knowledge if bradford council did this then they could effectively have claimed responsibility for the road! On another note I think that people living on these roads should have tax deductions, is this not fair seeing as their money is not paying for the road they live on to be maintained? |

This is a direct link to the actual document which is the decision notice in 1996 when the co-op was rebuilt. From all the above (and previous blogs)I think there is certainly clear agreement that Silsden has a problem with the state of one of its most heavily used thoroughfares. With the mulitude of interests involved it would seem an obvious case for the Town Council to take a leadership role and bring all parties together to determine an outcome - Co-op, Bradford MC and all residents who use Hillcrest/Spencer Avenues for acccess to their properties plus our district Coucillors - all of whom would welcome an inprovement to the situaton. Who implements and who pays for the improvements comes after some leadership is shown. |

raver.....well said, someone has to take the initiative and get the ball rolling with all the interested parties. However, whoever "leads" this will get nowhere quickly, as each party will close ranks and defend their corner...that's how it works these days. Sorry to be so cynical, but that's the way it is I'm afraid. Meantime, the risk is still there, and nothing changes unless serious pressure is brought to bear on decision makers. That's why I suggested starting with the Co-op, who have a lot to lose financially, and with a possible Lidl on the horizon, they could score some big points with the local people if they showed some initiative. |
