Hiya,

just wondering about this.

There is a big 'pothole' in a road near where I live. It's an unadopted road. If I were to creep out at midnight and fill it with concrete then stick a BIG metal plate over it to protect it til it hardened, would I get in trouble?

Obviously I'd make a proper job of it and it is a big enough plate to completely cover the hole and heavy enough not to move when driven over.

What do you reckon? or should I just call the council 'pothole' team and play dumb about the unadopted bit?

There is a legal presumption that a road is owned up to the midway point by the owner of the adjoining land (commonly referred to as "the frontagers").

An owner of an unadopted road is generally considered to have a right to undertake repairs and make improvements to the road, provided they do not interfere with other people's rights of way.

If you get the council to repair it they may recover the cost of repair from the frontager.

This information was taken from www.pendle.gov.uk/info/701/roads-adoption_agreements/963/unadopted_streets/2 not the same authority but it sounds about right.

The problem would be though that you would have to make the repairs in a competant manner or else you could leave yourself open to claims from persons using the road/pavements!

But there again you would also be if you did not repair the road! It is my understanding if you tripped or had an accident caused by lack of maintenance on an unadopted road you claim would be against the local property owners!

I remember somebody building their own speed hump on spencer ave a few years back,.wow what really great bit of work it was, it could have slowed a tractor down, but yey! the local good for nothing do-gooders complained and had it removed.

Id wait until one of the grumpies fall down it! maybe the council might sort it out?

Well obviously I'd do it to a good standard, I'm no bodger wink ;)

hmmm, maybe one of these nights I'll get some concrete in my wheelbarrow and have a walk. If it happens to tip up by accident and the concrete falls into a hole I can't help it can I?

Then it would be irresponsible to leave wet concrete uncovered, someone might step in it. So I'd have to put a board over it.

Just ask the people who live in the house that’s
Near the hole if you can fix it they own the road.

If this is the pothole on Hill Crest Avenue (next to the Co-op carpark), then you should ask the Co-op to fill it up. happy :)

I understand from talking with my parents that the army laid Spencer Ave years ago and there was some talk of them paying for repairs.they also laid the top part of the park(rugby pitch) just of interest.

After driving down the pothole last night I decided enough was enough so I've just emailed the co-ops head office to ask/tell them to get it filled in.

GRRRRR!! angry angry angry

OK, rang co-op head office to see if they had formulated a reply to my email yet. They can't find it, despite me getting an acknowldgement email. But that's at home so I'll have to print it off and bring it to work if I want to chase them up.

So I rang the manager at the Silsden store. He said he didn't even know there was a pot-hole! And anyway it wouldn't be their responsibility anyway. I explained about it being an unadopted road etc and he seemed to get it. He said he'd pass the details on to the property team and took my number.

I rang the council. They'll come and look but the lady said if it's the unadopted bit they won't fix it. I asked if they had any powers to fix it and sent the bill to the co-op. She said she didn't know.

like I said GRRRR angry angry

Surely Spencer Ave is adopted or why did the council paint double yellow lines on it?.They just wont want the expense of upkeep.

well it won't have been the co-op I don't imagine. I suppose the council did it not realising the road was unadopted.
