which council are you talking about?
i thought places could be open till midnight not 11pm?
ive heard on hear that possibly the chicago places stay open after midnight which is beyond their licence

Im guessing Localman it might be a noise issue it can get quite noisy around takeaways after people have been to the pub
people do live in the areas of the take aways
just a guess mind

Localman, dont't blame the council, either Local or Bradford, the rules were set a good few years ago by the national government, any food premises operating between 11pm and 5am has to have a premises license. If Tucos (which I like and use)do not have one they have to close, have a look at www.bradford.gov.uk/NR/rdonlyres/F6226413-FF92-4E7C-9DC4-B87D48677342/0/PREMISESPACKGrant_TakeawayOnly_.pdf

Whilst a Facebook petition is a nice idea, it won't do any good. If they wish to remain legally open after 11.00pm they will have to apply for a premises license from Bradford Met.

The reason being according to the website

"A premises licence is required for the sale of hot food or drink to members of the public between 11.00pm and 5.00am, for consumption on or off the premises. This includes businesses such as restaurants, takeaways and mobile food traders.

Late night refreshment is included as a ‘licensable activity’ within the Licensing Act 2003, as there is potential for nuisance and disturbance around premises which serve late night refreshment. The regulation of late night refreshment allows residents and other interested parties and responsible authorities to make representations about new premises, and seek
reviews of existing licences where they are concerned that the licensing objectives below will be or have been affected."

Chicago Hut can sell food until midnight. It was in the planning permission. So TUCOS need to get the same licence to be able to compete fairly. All takeaways should have the same rules and if Chicago Hut stay open after 12 then they should be stopped. Its not fair on TUCOS.

All Town and Parish councils were removed as statutory consultees on any license applications/amendments a number of years ago.

There is a case to allow them to open until midnight or half past 12 but the application to stay open until 3am is over the top.

Maybe they are planning on selling cocoa, horlicks and biscuits?

Don't get me wrong on occaision I call for a take away but no later than 11 or I would surely be up all night with indigestion. we do not even have pubs or clubs open until anything like 3 so they are hardly catching the passers by.

seems to me some or most of the people on here never go out in silsden as they do not know what time the pubs shut? if he wants to stay open till 3 then good luck to him people do go to nightclubs and want food when they go home, and its a handy place to pick food up from and good quality to.

Most people do not know the closing time of pubs as they do not stay until the 'bitter' end excuse the pun.
Take aways cause concern for several reasons they encourage people to eat in the street and some are then litterers, also the type of food containing much saturated fat, high salt content oftenmechanical reclaimed imported meat. Far healthier to go home and have a bowl of porridge!! and cheaper.

if I am having a good time with the many friends I have who cares what time it is life is for living not moaning about every little thing and in most cases it has nothing what so ever to do with you example this thread? please note if you are tucked up in bed at 11.30pm why is it an issue that a takeaway wants to stay open till 3.00am
