This is really bad, someone gets badly injured and they get away from paying £4000 by saying they have no money. Don't they have public liability. |

Hold on.The Sports Club is a not for profit organisation with minimum income where anything over turnover is invested in the grassroots clubs that use the sports club.Given Bradford Council have just decided that over the next ten years they want about £80,000 in extra rates they cant be well off.Thats an annual increase from £2,000 to £10,000 a year!.A big fine would have put it out of business and I know some would be happy with that until houses were built on site. Now I dont know for sure but I'm guessing the club does have Public Liability and if you read the story it says there is an ongoing civil case which will no doubt be dealt with by the insurance company. Its an awful tragedy for the postman and lets wish him well for the future and a swift conclusion of the civil case. |

If the Sports Club were a "not for profit organisation" they could register as a charity and claim reduced business rates. Why have they not registered as a charity? |

The sports club does not organise sporting events so cant register as a charity.It only provides facilities the football and cricket organise sports and the sports club only provides facilities |

So if anyone is injured whilst attending these events the club cannot be held responsible. |

The club can be held legally liable if it is proven that it was negligent or failed to take ‘reasonable care’ to prevent injury to a member of the Public or members of the club or damage to property. This liability arises because the club and its members have a duty of care to avoid carelessly causing injury to members of the public or damage to their property through the negligent act of the club and/or its members. |

Is the land still under control of the trustees, that being gifted to the people of silsden by the late Stanley Wass to be used for sports, or have things changed. |
