i see from the c herald today that £5000 of the £27000 to be spent across the district is going to repair a footpath up howden rd i walk up there and have seen nothing too bad,what about spencer ave(and dont moan about it being unadopted)disabled in wheelchairs ,pram users and walkers all use the road as the footpath supposedly damaged by TANKS IS ABOUT UNUSABLE,so as thats about 70 years ago so when are the powers involved going to got round to spencer ave are they going to wait for the next WAR     |

That is because Spencer ave is not the responsibility of the council but of the local residents - the road has not been adopted by the council. |

well we all know its a fact, the council could take it over as it was their housing that was originaly built up there and higher up at west and east dean etc,and it is a fact that nearly all users use the road to walk on. |

The point is that residents will have to pay for the council to adopt it.....that is why its unadopted |

Hi i agree with dogcatcher. The counsel can do Spencer ave up if they wish. There is no law that says the residents have to pay . The council have a moral duty to admit their mistake in allowing the developments of houses on Hunters meadow and Deans without adopting the access road ie Spencer ave and work to find funds to do the road up to make up for their mistake. i feel let down by our counsel and their disregard of the campaigns to improve Spencer ave.i have seen nothing similar for Howden rd. very unhappy |

But there is - the construction company who built the houses up there should have brought the road up to spec then the council would have adopted it. As it is they have to protect the rights of other council tax payers - why should they pay to bring it up to spec. |

The council own it and know they do but do not want to spend money in Silsden If they the council didnt own it do you think they would have painted double yellow lines without permission. Do you think they would have installed street lighting or maintained street lighting. Would they really have allowed the housing estate at the top of Hillcrest Avenue to be built if access was only up a private road. Would Silsden UDC have built a council estate with access over a private road.
The council have a duty to empty wheelie bins. The local residents should operate toll road charging council vehicles £500 a time to pay for the repars |

Didn't say they didn't own it - and I see no proof they do. Fact remains that the road is unadopted and until its brought up to standard will remain so. |

There was an interesting bit on TV this week about an estate where some of the lights were turned off because the roads and lights had not been adopted. The developer should have been paying the electricity bill, not the local authority. It was all because the developer had gone bust before bringing these items up to the standard required by the local authority.
I was quite surprised to learn the situation can still happen today.
If the lights are on up Spencer Avenue then the local authority must have adopted them along with the road. If this situation has existed for a long time then it might be argued that the local authority has adopted all of the infrastructure and therefore the road.
Of course going to law over this would probably be more expensive than coughing up to fix the road.
Good luck - but I suspect big brother unfortunately has the whip hand. |

just as i thought moaning and the excuse of unadopted always comes up always negative thoughts so lets take note of the positive thoughts on here,it was the council that was complained to when some idiot built an illegal speed bump on spencer av a few years back and it was the council that had it removed????? as folk av said payers of council tax, lighting, bins emtied,drains cleaned out,yellow lines, rights of way to the deans also council housing originally and planning permission for hunters meadow the council dont own it my aris  |

Hi rather than going round in circles re who responsible for doing road up, is anyone willing to raise funds to do Spencer ave up?I have time but no idea how to go about fund raising. |
