Topic : MPs think they know better than High Court Judges |

www.guardian.co.uk/world/2010/feb/26/binyam-mohamed-torture-ruling-government So the government now think they know better than the High court Judges who have seen the evidence. Time we got this arrogant lot out and had a fresh government I think. I'm not thrilled about the prospect of a Tory government but I just can't stomach another term of these current lot. It's a poor state of affairs when there's no one party you feel you want in power (that's worth voting for). :[ |

When I was at school they taught us that there were three parts of government. The executive, the legislature and the judiciary. So long as they were in reasonable balance and one group did not let the others get out of hand the system works. This is an example of the system working. The fault is a much with the executive, the civil servants, as with the legislature. Basically it shows that secret services can display incompetence at times. In this case twice. Firstly the use of torture is unlikely to give reliable information, and secondly being found out. The Israelies have shown their incompetence recently. The solution there was for MI6 and Mossard, supposedly on the same side, to have swapped 'genuine but untraceable' identities. Genuine in that they would be verified on international databases. The actual names caould be false. The spies really need to read a few more spy novels. |

if thought my family was in danger ie by a hidden bomb and a suspect was under arrest then if torture was the only way to make him or her talk then so be it? To torture with no real end result is wrong but if lives are at risk then who comes first? as is the norm in this country its the suspect or the criminal that has more rights than the normal law abiding person. Human rights act its time for it to go and if the tories say its going then I for one will vote for them. |

Torture is not only morally wrong it is ineffective in that the quality of the intelligence obtained is generally very poor anyway. Whether we agree with it or not isn't really the case. The US courts have already agreed that this man was tortured, or subject at least to interrogation techniques that we in this country do not agree with. Then our High Court have found that MI5 knew about his treatment and were therefore complicite in it. The Home Secretary, instead of saying, "We'll investigate this because MI5 told us they knew nothing about his unacceptable treatment," has said "Oh those judges know nothing, its all rubbish!" I just find that so typical of this administration. Why can't they be straight and admit sometimes things go wrong and people do things they know they shouldn't and we'll do our best to put it right and prevent it happening in future. They would go up in my esteem if they did this, but they just aren't big enough to do it. Instead they think they are better at assesing evidence than the High Court and in behaving like this they undermine the judicial system. After all if politicians can reject judges finding then why can't we all reject authority? |
